What is a statutory will? A lesser known but powerful tool
About this Episode
A statutory will is one the Court makes on behalf of a person who doesn't have the capacity to make one themselves. It's not well known, but in the right situation it can make all the difference - and it's exactly the kind of tool that an experienced estate lawyer knows to reach for when a standard will isn't possible.
In this conversation:
- A minor receiving a compensation settlement. If a child receives a significant lump sum, they may need estate planning in place despite being too young to make a will. An application can be made to the Court on their behalf.
- An older couple who divorce where one has lost capacity. If one spouse can no longer update their will, a statutory will lets an application be made to reflect their changed circumstances – so a former spouse doesn’t inherit under an outdated will.
